The legitimization process of electronic communications law systematization
The legitimation process of the electronic communications law systematization serves as the foundation for recognition of the possibility and feasibility of updating the legal framework of interaction between the state and society. Representatives of the three working groups of Ukrainian MPs have developed bills “On Electronic Communications”.
Europe has set Ukraine’s commitment to reform the telecommunication sector — to implement deregulation in the field of electronic communications and regulate the operation of electronic communications networks, provision of electronic communications services. Representatives of the three working groups of Ukrainian MPs have developed bills “On Electronic Communications” (No 3549, 3549-1, 3549-2).
Anna Barikova, expert of the Center of Policy and Legal Reform, participated in the international conference “State and Law: Problems of Establishment and Perspectives of Development” (Uzhhorod, December 25-26, 2015) on the process of legitimizing the systematization electronic communications law. The report shows the required format of relations between parliament, public administration and private law entities involved in the provision of electronic communications services and other activities to manage license plate and radio frequency resources (for example, four-circuit power on the state, regional, district and communities levels in accordance with the principles of independence and subsidiarity).
The reality of the political and socio-economic situation in Ukraine was revealed, especially functioning of the electronic communications market, as well as a public interest in the activities of its participants. Anna Barikova formulated suggestions on the essense of the electronic communications systematization process.
Thus, the legitimation process of the electronic communications law systematization serves as the foundation for recognition of the possibility and feasibility of updating the legal framework of interaction between the state and society, including citizens — consumers of electronic communications services. An important factor in this process is to reach agreement and expression of the will of society in elaborated legislative initiatives.
