Strategic goal: Fair judiciary
Tasks:
- Facilitate the adoption of standards for the integrity of judges.
- Facilitate the strengthening of the independence of the judiciary.
- Facilitate the creation of effective, honest, and independent judicial self-governance bodies.
- Facilitate the formation of an accessible and efficient judiciary. Strengthening the service orientation in the work of courts.
- Facilitate the implementation of measures identified in the Justice System Reform Concept, developed within the framework of the project “Ukraine after the Victory” (Vision Ukraine 2030).
- Facilitate the alignment of Ukrainian legislation with the EU’s requirements (Chapter 23).
Indicators of achieving the goal:
- Legislative and procedural changes relating to the introduction of instruments for strengthening the integrity standards among judicial ranks were ensured.
- Draft laws that create threats to the independence of the judicial branch in Ukraine were blocked (i.e., prevented from being adopted, promoted, etc.).
- Annual shadow reports on the state of the independence of judges and the implementation of developed recommendations are being published.
- Communication with the High Council of Justice and the High Qualification Commission of Judges was established. Both bodies take the CPLR’s recommendations into account in their work.
- Procedural legislation was optimised, including through simplification (de-bureaucratization) of court procedures and implementation of e-justice, as well as changes in the organisation of court activities to increase the level of satisfaction of users of court services.
- Developments of the CPLR were taken into account in the draft law “On Judicial Reform”.
- Indicators identified in the justice system reform concept “Ukraine after the Victory: Vision Ukraine 2030” were achieved.
- The position of the CPLR was taken into account in the laws regarding European integration.
Main achievements of the area:
- An analytical report “Ukrainian Justice Matrix: Assessment of the Ukrainian Justice System under the EU Justice Scoreboard 2022 Methodology” was prepared, which, for the first time, assessed the national justice system under the methodology used in the EU member states.
- Jointly with colleagues from partner organisations, a policy document “The entrance exam for Ukraine: what we should do to implement the EU recommendations” was developed. Subsequently, experts were involved in monitoring the implementation of the European Commission’s recommendations on Ukraine’s EU candidacy (the “Candidate Check” project).
- The Justice System Reform Concept was developed jointly with partners as part of “Ukraine after the Victory: Vision Ukraine — 2030” project.
- Jointly with experts in the constitutionalism area, the monitoring report “Local self-governance through the prism of court practice (2017-2023)” was prepared as part of the U-LEAD with Europe project.
