Strategic goal: Authorities subordinated to the democratic Constitution
Tasks:
- Preserve democracy during the war and enhance it after the Victory.
- Ensure the conduct of post-war elections is in line with constitutional principles and based on a democratic procedure.
- Facilitate the improvement of a mixed form of governance in the interests of society and the protection against authoritarian tendencies and imbalances among the branches of government.
- Strengthen the parliamentarism.
- Facilitate the strengthening of independence and capacity of the Constitutional Court of Ukraine.
- Facilitate the implementation of the provisions of the Constitution of Ukraine, particularly for guaranteeing human and citizen rights.
- Facilitate the consideration of the civil society’s position in the plans for the reconstruction of Ukraine (in connection with constitutional law).
Indicators of achieving the goal:
- Legislative changes that address key challenges of the post-war elections are developed and implemented.
- The Constitution is amended with regards to the branches of power triangle in the interests of unity and efficiency of the country’s development policy. There are no constitutional amendments that strengthen the President and further unbalance the power triangle.
- The Parliament’s institutional capacity is strengthened, notably as a result of an MP’s status.
- The Constitutional Court of Ukraine functions as an independent institution with growing trust. Positions in the CCU are filled on the basis of real competition. More professional, moral, and independent lawyers are selected for the positions of judges in the CCU.
- The number of gaps in constitutional laws is reduced. Courts of general jurisdiction and the Constitutional Court of Ukraine exercise adequate protection of constitutional human and citizen rights in their practice by applying the Constitution’s norms as norms of direct effect.
- Public discussions with the society on a variety of topics (e.g., constitutional order, parliamentarianism, etc.) are conducted.
Main achievements of the area:
- An advocacy campaign aimed at adopting the Law of Ukraine “On the all-Ukrainian referendum” was conducted.
- The draft Law of Ukraine “On local referendum” was prepared.
- An advocacy campaign aimed at introducing a competitive selection to the Constitutional Court of Ukraine was conducted.
- The Constitutional and Parliamentary Reform Concept was developed as part of the “Ukraine after the Victory: Vision Ukraine — 2030” project.
- Drafts of the Green and White Books of the legislative process were prepared.
- The Green and White Books of constitutional reform and proposals for constitutional amendments concerning the power triangle were prepared.
- Protection of the constitutional rights of Ukrainian citizens in the Constitutional Court of Ukraine was ensured.
