Strategic goal: Protection from unlawful encroachments

Tasks:

  1. Facilitate the strengthening of the institutional capacity of the military justice system, aimed at restoring justice for victims of international crimes committed by the russian federation and reforming the military justice bodies.
  2. Facilitate the improvements in criminal procedure in accordance with European standards and in light of the risks posed by ineffective justice in Ukraine, in particular by improving the institution of plea agreements and reconciliation, introducing a mechanism for countering the abuse of procedural rights, etc. and facilitating the improvement of quality and efficiency of criminal law.
  3. Facilitate the strengthening of the institutional capacity of law enforcement and prosecutorial bodies, in particular by ensuring the institutional independence of Specialized Anti-Corruption Prosecutor’s Office.
  4. Develop a comprehensive vision for transitional justice in regard to law and order (“Ukraine after the Victory: Vision Ukraine — 2030”, state policy documents relating to de-occupation, Safe Community concept, etc.).

Indicators of achieving the goal:

  1. Amendments to legislation on ensuring the activities of specialised units/bodies for the investigation of international crimes (military justice bodies) are introduced and the military justice system is reformed (primarily, the Military Law and Order Service).
  2. Well-grounded amendments to the Code on Administrative Offences are prepared.
  3. A draft of the new Criminal Code is prepared (partially completed).
  4. A comprehensive vision for decisions in the area of transitional justice during the war and after Ukraine’s victory is formulated (concept papers, plans, visions, etc. are in place).

Main achievements of the area:

  1. Ongoing participation in the International Council of Experts – an advisory body to the Office of the Prosecutor General on the prosecution of those responsible for international crimes and the development of the military justice system, as well as in the Interagency Working Group on the development of the Action Plan for the implementation of the Comprehensive Strategic Plan for the Reform of law and order agencies (approved by the Decree of the President of Ukraine on May 11, 2023 № 273).
  2. Proposals to the State Anti-Corruption Program for 2023-2025 were submitted, including through participation in working groups and consultations, as were proposals to a number of legislative acts in the area of criminal procedure development, analytical documents of the Prosecutor’s Office and the Ministry of Internal Affairs in the area of military justice, as well as disciplinary and personnel issues of police activity.
  3. White Book on depoliticisation of law and order and prosecution agencies: appointment/dismissal of leadership was prepared.
  4. A study on “Assessment of the State Policy in the area of reforming the Prosecutors Office of Ukraine in 2014-2023” was conducted (in cooperation with Mykola Khavroniuk, lead of the anti-corruption area), and draft Law of Ukraine “On amendments to the Law of Ukraine “On the Prosecutor’s Office” was prepared.
