Municipality as a Legal Entity under Public Law: Ukraine in the context of European and World Experience

The monograph examines the historical traditions of the formation of the identity of communities in Ukraine, the peculiarities of constitutional and legal regulation of the status of communities as legal entities of public law in the countries of the European Union, reveals the elements of this status, the relationship between granting the status of a legal entity to communities and guaranteeing their autonomy and a fuller implementation of the fundamental principles of local self-government, the impact of the introduction of such a status on the fullness of community powers.

It analyses the need for necessary amendments to the Constitution of Ukraine and current legislation in order to grant communities the status of a legal entity, and includes a draft Concept of a Community as a Legal Entity under Public Law developed by the authors of the monograph, which provides for amendments to legislation on local self-government, civil, budgetary and tax legislation.

For local self-government officials, researchers, teachers, students of law and other humanitarian educational institutions, legal practitioners, and anyone interested in the organisation of state authority and local self-government.
