{"id":9838,"date":"2010-04-01T13:25:33","date_gmt":"2010-04-01T10:25:33","guid":{"rendered":"https:\/\/pravo.org.ua\/centre-for-political-and-legal-reforms-statement-on-political-reform-in-ukraine\/"},"modified":"2024-11-01T14:52:11","modified_gmt":"2024-11-01T12:52:11","slug":"centre-for-political-and-legal-reforms-statement-on-political-reform-in-ukraine","status":"publish","type":"post","link":"https:\/\/pravo.org.ua\/en\/centre-for-political-and-legal-reforms-statement-on-political-reform-in-ukraine\/","title":{"rendered":"Centre for Political and Legal Reforms Statement on \u201cpolitical reform\u201d in Ukraine"},"content":{"rendered":"<h2>\n\t<a class=\"main_zag\">Centre for Political and Legal Reforms Statement on \u201cpolitical reform\u201d in Ukraine<\/a><\/h2>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t<span lang=\"EN-US\">On December 8,<\/span> 2004<span lang=\"EN-US\"> the Supreme Rada of Ukraine passed both: Law, which minimizes possible falsifications of public will during revoting of the second round of Presidential election on December<\/span> 26<span lang=\"EN-US\">,<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">and Law of Ukraine<\/span> \u201c<span lang=\"EN-US\">On amending of the Constitution of Ukraine\u201d<\/span> (<span lang=\"EN-US\">draft law<\/span> \u21164180).<span lang=\"EN-US\"> <\/span><\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t&nbsp;<\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t<span lang=\"EN-US\">Greeting this tactic victory of the Ukrainian opposition, which cleaned the way to legitimate victory of Viktor Yushchenko on Presidential election in Ukraine<\/span>, <span lang=\"EN-US\">we have to state, that such victory is of a high price<\/span>. <span lang=\"EN-US\">We as Ukrainian citizens and lawyers are worried of<\/span>:<span lang=\"EN-US\"> <\/span><\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t&nbsp;<\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t<span lang=\"EN-US\">the attitude to the Constitution of Ukraine to be the object of political wrangle<\/span>; <span lang=\"EN-US\"> <\/span><\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t&nbsp;<\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t<span lang=\"EN-US\">danger for the Ukrainian parliamentary<\/span>,<span lang=\"EN-US\"> called by changes of the Constitution, that deals with establishing an imperative mandate of MPs, excluding rules on law regulation of the Supreme Rada activity and increasing authorities term of the Supreme Rada, local and regional radas up to five years<\/span>;<span> <\/span><span lang=\"EN-US\"> <\/span><\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t&nbsp;<\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t<span lang=\"EN-US\">incompletion and contradiction of legal regulation of the order of the Government building, which is unfamiliar for any State in the World, and of dangers for effective functioning of executive power<\/span>; <span lang=\"EN-US\"> <\/span><\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t&nbsp;<\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t<span lang=\"EN-US\">the Prosecutor\u2019s Office has got back the function of general supervision<\/span>;<span lang=\"EN-US\"> <\/span><\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t&nbsp;<\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t<span lang=\"EN-US\">the fact<\/span>, <span lang=\"EN-US\">that approving of this law simultaneously means victory of the Ukrainian oligarchy, mainly personified as L. Kuchma, v. Medvechuk, V. Pinchuk and others, who have got a chance to continue influence over Ukrainian power.<span> <\/span><\/span><\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t&nbsp;<\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t<span lang=\"EN-US\">But disappointment is followed not only by the fact of amending of the Constitution of Ukraine by many non sustaining provisions, but also that opposition, mainly fraction \u201cOur Ukraine\u201d failed to use many means to avoid such situation \u2013 vote for such compromise<\/span>. <span lang=\"EN-US\">Partly<\/span>, <span lang=\"EN-US\">neither<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">society<\/span>, <span lang=\"EN-US\">nor<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">Parliament<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">wasn<\/span>\u2019<span lang=\"EN-US\">t<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">explained<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">clearly<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">in<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">time<\/span>, <span lang=\"EN-US\">that<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">main<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">problems<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">in<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">the<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">system<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">of<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">power<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">in<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">Ukraine<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">are<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">connected<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">not<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">with<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">the<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">Constitution<\/span>, <span lang=\"EN-US\">but<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">with<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">its<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">nonobservance<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">and<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">perversion<\/span>, <span lang=\"EN-US\">first<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">of<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">all<\/span>, <span lang=\"EN-US\">by the President Kuchma<\/span>. <span lang=\"EN-US\">Thus<\/span>, <span lang=\"EN-US\">any<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">reform<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">must<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">begin<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">from<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">observance of effective Constitution and passing the laws on the President of Ukraine, Cabinet of Ministars of Ukraine, others, that have to concretize the constitution, and all its perversion have to stop<\/span>.<span lang=\"EN-US\"> No steps were taken in this direction, as no oppositional draft on amending of the Constitution wasn\u2019t submitted<\/span>, <span lang=\"EN-US\">which could legally correctly decide a problem of balancing of state power in Ukraine, make impossible usurpation of authorities and refute accusation of Viktor Yushchenko for will to rule as Kuchma<\/span>.<span lang=\"EN-US\"> <\/span><\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t&nbsp;<\/p>\n<p align=\"justify\" class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt;\">\n\t<span lang=\"EN-US\">We<\/span>, <span lang=\"EN-US\">Centre for Political and Legal Reforms<\/span>, <span lang=\"EN-US\">as one of analytical organizations<\/span>, <span lang=\"EN-US\">which specialized on promotion of development of the Ukrainian Public Law,<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">didn\u2019t stay outside as passive observers<\/span>. <span lang=\"EN-US\">On<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">our<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">own<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">initiative<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">during<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">a<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">long<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">time<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">we<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">tried<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">to<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">inform<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">politics<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">of<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">the<\/span><span lang=\"EN-US\"> <\/span><span lang=\"EN-US\">fraction \u201cOur Ukraine\u201d. With this aim we prepared and submitted them draft laws \u201cOn the President of Ukraine\u201d (for third reading), \u201cOn bodies of executive power\u201d, \u201cOn amending of the Constitution of Ukraine\u201d, other draft laws and analytical materials.
