Such a decision was based on the results of the Committee\u2019s meetings held on November 16-17 and was set out in the Committee\u2019s Opinion attached to the reference card of the draft law.<\/p>\n\n\n\n<p><strong>CPLR\u2019s expert assessment<\/strong><\/p>\n\n\n\n<p>The adoption of this decision was preceded by the Committee\u2019s <em>re-voting<\/em> on the decision due to its critical perception by individual MPs, representatives of civil society, and other individuals who monitor the reform of the Specialized Anti-Corruption Prosecutor\u2019s Office (for example: <a href=\"https:\/\/www.facebook.com\/anastasia.krasnosilska\/posts\/pfbid0sfSsuDqYXWb1pCaeDYW2qsosZSmgSSCiz4SgoP9tbHW9Jr5hVrxXqLthyk5BbyfNl?__cft__%5B0%5D=AZUEGnGv7_oV-mESY5YUSdCEltGVUMHIFdDNw2etG0LqjQTnP1QLaiAQXaB6MQbN7EjUcbfc8rJGOmi6vzV8C4JKm2WvFUzVHyAQIeofl4_ua71czyfShHUSgoal0vOEadYBP-ElvONaW9hfD6PFiG-b&amp;__tn__=%2CO%2CP-R\" target=\"_blank\" rel=\"noreferrer noopener\">1<\/a>, <a href=\"https:\/\/www.facebook.com\/yaroslav.yurchyshyn\/posts\/pfbid0Qm3zxGYa9BgpsLkmUbGafpna3VzVQauPg7S5c7Ek6N6EgQ5CsTx8dvPSMcnaAfkZl?__cft__%5B0%5D=AZXLaHFsdG9vpZmv3hlvzyuZ5kDyaQgEi8_Pp45wYogkYeNgh0D1y6MS1DW_VlwCMLJsMNi1xRWwNrS9aEUaZJ_lG3SDCdcnHsuVMJT44UzEOcQK2kp7lpvGUH0Wr4dRLqsJ_vGYdrmsCrzNvanKJbSTHSSQ_MPoFQPmvRglWx2T2w&amp;__tn__=%2CO%2CP-R\" target=\"_blank\" rel=\"noreferrer noopener\">2<\/a>, <a href=\"https:\/\/antac.org.ua\/news\/pravookhoronnyy-komitet-parlamentu-proponuie-imituvaty-nezalezhnist-sap-ta-vidmovliaietsia-skasuvaty-pravky-lozovoho\/?fbclid=IwAR2N2sjO7p9zyn4QxW2sZzJoibXgCB3WC_eM586VFyvLEFUK185E6Pqt5gg\" target=\"_blank\" rel=\"noreferrer noopener\">3<\/a>).<\/p>\n\n\n\n<p>Currently, there are three draft laws under the Parliament\u2019s consideration:<\/p>\n\n\n\n<p>1) \u211610060 (primary draft, initiated by the Cabinet of Ministers of Ukraine (aka the Government\u2019s draft law)): <em>the CPLR\u2019s experts have previously provided analysis of this draft law, see opinion <\/em><a href=\"https:\/\/pravo.org.ua\/blogs\/vysnovok-tsentru-polityko-pravovyh-reform-shhodo-proyektu-zakonu-10060-vid-15-09-2023\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>here<\/em><\/a>;&nbsp;<\/p>\n\n\n\n<p>2) \u211610060-1 (alternative draft, initiated by V. Neklyudov and other MPs);<\/p>\n\n\n\n<p>3) \u211610060-2 (alternative draft, initiated by Radina A. and other MPs): <em>the CPLR\u2019s experts have previously provided analysis of this draft law, see opinion <\/em><a href=\"https:\/\/pravo.org.ua\/blogs\/strong-vysnovok-strong-strong-shhodo-proyektu-zakonu-pro-vnesennya-zmin-do-kryminalnogo-strong-strong-protsesualnogo-kodeksu-ukrayiny-ta-inshyh-zakonodavchyh-aktiv-strong-strong-ukrayiny-shhodo-posyle\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>here<\/em><\/a>).<\/p>\n\n\n\n<p>All of these drafts envision four key components of the reform of the SAP:<\/p>\n\n\n\n<p>1) improving the procedure for appointing the head of the SAP;<\/p>\n\n\n\n<p>2) providing the SAP with the status of an independent legal entity, with corresponding legal implications;<\/p>\n\n\n\n<p>3) implementing the procedure of independent periodic assessment (audit) of the SAP;<\/p>\n\n\n\n<p>4) creating the SAP\u2019s own disciplinary commission, alongside the existing, permanently functioning Qualification and Disciplinary Commission of Prosecutors.<\/p>\n\n\n\n<p>Special attention to the reform of the SAP (strengthening its autonomy and independence) is caused by the fact that it is part of Ukraine\u2019s European integration obligations. In light of this fact, the Government of Ukraine has developed draft law \u211610060 in order to fulfill Ukraine\u2019s commitments, made in accordance with the Letter of Intent of the Government of Ukraine to the International Monetary Fund and to implement paragraph 61 of the Memorandum on Economic and Financial Policy of June 19, 2023 and paragraph 56 of the updated Memorandum on Economic and Financial Policy of March 24, 2023.<\/p>\n\n\n\n<p>Following the submission of the alternative drafts and a number of critical evaluation opinions regarding certain provisions of the government\u2019s draft law, a working group was <a href=\"https:\/\/www.facebook.com\/permalink.php?story_fbid=pfbid0216AtFJsaB4Yh9hDxodYnC2JVoEQw1ZvuEwnqC3y9j9kmkjdVd5GbQZEqwpH8YPDRl&amp;id=100088390204477\" target=\"_blank\" rel=\"noreferrer noopener\">created<\/a> on October 10 within the Parliament\u2019s Committee on Law Enforcement Activities. The group\u2019s objective was to bring the principal and the alternative drafts into alignment taking into account proposals, critical remarks, and Ukraine\u2019s international partners\u2019 assessments, as well as to present the <em>revised<\/em> <em>version<\/em> of the legislative initiative.<\/p>\n\n\n\n<p>Ultimately, on November 16, the Parliament\u2019s Committee on Law Enforcement Activities recommended at its meeting that the Parliament to adopt a revised version of the draft law, which was not agreed upon among members of the working group. According to the working group members, the revised version contained provisions that would strengthen the political influence on the SAP through excessive interference in the selection process of the head of the SAP. It also did not take into account the proposals to increase the efficiency of the SAP envisioned in alternative draft laws, primarily the provisions regarding the final repeal of the so-called \u201c<a href=\"https:\/\/zn.ua\/ukr\/anticorruption\/skasuvannja-popravok-lozovoho-chi-poverne-zakonoprojekt-10100-balans-u-sistemu-obchislennja-strokiv-rozsliduvannja.html\" target=\"_blank\" rel=\"noreferrer noopener\">Lozovyi amendments<\/a>\u201d.&nbsp;<\/p>\n\n\n\n<p>On the same day, following the above-mentioned public criticism, a meeting was held with the President, which impacted the subsequent change in the Committee\u2019s position and was most likely motivated by the need to comply with the European integration obligations. <a href=\"https:\/\/www.facebook.com\/anastasia.krasnosilska\/posts\/pfbid0sfSsuDqYXWb1pCaeDYW2qsosZSmgSSCiz4SgoP9tbHW9Jr5hVrxXqLthyk5BbyfNl?__cft__%5B0%5D=AZUEGnGv7_oV-mESY5YUSdCEltGVUMHIFdDNw2etG0LqjQTnP1QLaiAQXaB6MQbN7EjUcbfc8rJGOmi6vzV8C4JKm2WvFUzVHyAQIeofl4_ua71czyfShHUSgoal0vOEadYBP-ElvONaW9hfD6PFiG-b&amp;__tn__=%2CO%2CP-R\" target=\"_blank\" rel=\"noreferrer noopener\">According<\/a> to the Head of the Committee on Anti-corruption Policy, MP Anastasia Radina, \u201c<em>we should thank the President for his principled position regarding the fulfillment of our obligations to international partners<\/em>\u201d.&nbsp;<\/p>\n\n\n\n<p>Such motives can be confirmed by a letter of G7 ambassadors who, according to <a href=\"https:\/\/www.eurointegration.com.ua\/news\/2023\/11\/20\/7173920\/\" target=\"_blank\" rel=\"noreferrer noopener\">Evropeiska Pravda<\/a>, addressed the head of the Verkhovna Rada, Ruslan Stefanchuk, with a letter explaining that only one of the proposed draft laws on strengthening the SAP\u2019s independence meets international requirements, namely the Government\u2019s draft law \u211610060.<\/p>\n\n\n\n<p>On November 17, the Committee, guided by Part 5 of Art. 44 of the Law of Ukraine \u201cOn Committees of the Verkhovna Rada of Ukraine\u201d, re-voted its original decision (meeting minutes \u2116 167), as indicated in the most recent version of its Opinion.
