{"id":5000,"date":"2023-08-07T20:20:38","date_gmt":"2023-08-07T17:20:38","guid":{"rendered":"https:\/\/pravo.org.ua\/analytical-materials\/weekly-analytics-for-2-8-august\/"},"modified":"2025-08-07T16:04:04","modified_gmt":"2025-08-07T13:04:04","slug":"weekly-analytics-for-2-8-august","status":"publish","type":"analytical-materials","link":"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-2-8-august\/","title":{"rendered":"Weekly analytics for 2 \u2014 8 August"},"content":{"rendered":"<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_69_1 counter-flat ez-toc-counter ez-toc-transparent ez-toc-container-direction\">\n<div class=\"ez-toc-title-container\">\n<p class=\"ez-toc-title\" style=\"cursor:inherit\">Sections<\/p>\n<span class=\"ez-toc-title-toggle\"><\/span><\/div>\n<nav><ul class='ez-toc-list ez-toc-list-level-1 ' ><li class='ez-toc-page-1'><a class=\"ez-toc-link ez-toc-heading-1\" href=\"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-2-8-august\/#Legal_terminology_is_gradually_being_brought_into_line_with_the_Constitution_of_Ukraine\" title=\"Legal terminology is gradually being brought into line with the Constitution of Ukraine\">Legal terminology is gradually being brought into line with the Constitution of Ukraine<\/a><\/li><\/ul><\/nav><\/div>\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legal_terminology_is_gradually_being_brought_into_line_with_the_Constitution_of_Ukraine\"><\/span>Legal terminology is gradually being brought into line with the Constitution of Ukraine<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p><em>Event<\/em><\/p>\n\n\n\n<p>On August 3, 2023, <a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/3022-20#Text\" target=\"_blank\" rel=\"noreferrer noopener\">Law of Ukraine <\/a>\u2116 3022-IX \u201cOn Amendments to Certain Legislative Acts of Ukraine on Simplification of Access to Free Legal Aid\u201d entered into force, which provides for replacement of references to the phrase \u201clegal aid\u201d (pravova dopomoha) in all conjugations with the phrase \u201clegal aid\u201d (pravnycha dopomoha).<\/p>\n\n\n\n<p>These changes were adopted to implement the provisions of the Constitution of Ukraine, the current version of which was <a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/1401-19#n141\" target=\"_blank\" rel=\"noreferrer noopener\">revised<\/a> in 2016. According to Art. 59 and Art. 131-2, the right to legal aid (pravnycha dopomoha) and the procedure for its implementation were changed; namely, the wording <em>\u201clegal aid<\/em>\u201d (pravova dopomoha) was replaced with \u201c<em>legal aid<\/em>\u201d (pravnycha dopomoha).<\/p>\n\n\n\n<p><em>CPLR\u2019s assessment<\/em><\/p>\n\n\n\n<p>The term <em>\u201c<\/em><em>legal aid<\/em><em>\u201d<\/em> (pravnycha dopomoha) is more intrinsic to the Ukrainian language; thus, this is a positive step towards the development of Ukrainian legal terminology, ridding it of the negative influence of Russian language, and returning to the strength of linguistic traditions.<\/p>\n\n\n\n<p>At the same time, the legal terminology used in the Constitution of Ukraine since 2016has not been fully implemented in the legislation. For example, the Constitution refers the functions of the prosecutor\u2019s office relating to <em>\u201c<\/em><em>supporting public prosecution in court<\/em><em>\u201d<\/em> (Article 131-1), while the relevant Law still mentions \u201c<em>supporting state prosecution in court<\/em>\u201d; the Constitution speaks of \u201c<em>legal professions<\/em>\u201d (Article 130), while the relevant legislation provides for \u201c<em>juridical<\/em><em> education<\/em>\u201d (lawyer\u2019s profession, provision of juridical services, etc.); the Constitution refers to the prosecutor\u2019s office \u201csupervision of undercover and other investigative and search actions of <em>law <\/em><em>and order<\/em><em> agencies<\/em>\u201d, while the legislation mostly uses the term \u201c<em>law enforcement agencies<\/em>\u201d (rarely \u2013 \u201c<em>law <\/em><em>and order<\/em><em> agencies<\/em>\u201d).<\/p>\n\n\n\n<p>Furthermore, there are ongoing discussions in the professional environment regarding the need to update some of the legal terminology. Among the well-known examples are the replacement of \u201c<em>human rights<\/em>\u201d (prava liudyny) with \u201c<em>human rights<\/em>\u201d (liudski prava); \u201crule of law\u201d (verkhovenstvo prava) with \u201crule of law\u201d (pravovladdia); \u201cfundamental rights and freedoms\u201d (osnovopolozhni prava i svobody) to \u201cfundamental rights and freedoms\u201d (zasadnychi prava i svobody), etc. The justifications for most of these proposals are based on the peculiarities of word formation and grammatical traditions of the Ukrainian language. Moreover, legal semantics affects legal relations in society, as it has to do not with the simple usage of words, but with providing substantive content to legal institutions in question. For example, if \u201c<em>state prosecution<\/em>\u201d demonstrates the affiliation of the prosecutor\u2019s office to the state, as if it were a subsidiary body of executive power, then the term \u201c<em>public prosecution<\/em>\u201d refers to public prosecution for criminal offenses, which is a common cause of the society (in the cases of private prosecution, this function can be transferred to the victim in certain cases specified by law) and, ultimately, an element of justice and the judicial branch of power per se. According to legal semantics, the attitude towards the prosecutor\u2019s office changes in this case, which has a positive impact on the effectiveness of its activities.<\/p>\n\n\n\n<p><em>Conclusion. <\/em>First of all, the legislation is gradually being brought into line with the Constitution of Ukraine which, according to the hierarchy of legal norms, has the highest legal force. At the same time, a significant portion of the terminology remains inconsistent with the Constitution or contains a number of contradictions at the level of laws, and especially regulations.
