id=\"Parliament_adopts_the_law_on_liquidation_of_the_DACK\"><\/span>Parliament adopts the law on liquidation of the DACK<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p><strong>Event<\/strong><\/p>\n\n\n\n<p>On December 13, Verkhovna Rada adopted the following laws:<\/p>\n\n\n\n<p>1.\u00abOn liquidation of the District Administrative Court of Kyiv and establishment of the Kyiv City District Administrative Court\u00bb\u00a0<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/2825-IX#Text\" target=\"_blank\" rel=\"noreferrer noopener\">\u2116 2825-IX<\/a>\u00a0(draft law\u00a0<a href=\"http:\/\/w1.c1.rada.gov.ua\/pls\/zweb2\/webproc4_1?pf3511=71646\" target=\"_blank\" rel=\"noreferrer noopener\">\u2116 5369<\/a>\u00a0was introduced by the President of Ukraine as urgent on April 13, 2021), which provides for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the liquidation of the District Administrative Court of Kyiv (DACK);<\/li>\n\n\n\n<li>the creation of the Kyiv City District Administrative Court in Kyiv with the jurisdiction extending to Kyiv City;<\/li>\n\n\n\n<li>the transfer of cases to the Kyiv District Administrative Court, which will consider cases under the DACK jurisdiction until the Kyiv City District Administrative Court begins to operate.<\/li>\n<\/ul>\n\n\n\n<p>2. \u00abOn amending Section XII \u00abFinal and Transitional Provisions\u00bb of the Law of Ukraine \u00abOn the Judiciary and the Status of Judges\u00bb\u00a0<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/2826-IX#Text\" target=\"_blank\" rel=\"noreferrer noopener\">\u2116 2826-IX<\/a>\u00a0(draft law\u00a0<a href=\"http:\/\/w1.c1.rada.gov.ua\/pls\/zweb2\/webproc4_1?pf3511=71647\" target=\"_blank\" rel=\"noreferrer noopener\">\u2116 5370<\/a>\u00a0was introduced by the President of Ukraine on April 13, 2021 as urgent), which supplements the transitional provisions of this Law with a clause on non-application of provisions of Part 6 of Article 147, which provides that the court being liquidated continues to administer justice until a new court is established.<\/p>\n\n\n\n<p>The Head of Parliament and the President signed the laws on the same day and they entered into force on December 15.<\/p>\n\n\n\n<p><strong>CPLR\u2019s assessment<\/strong><\/p>\n\n\n\n<p>1.The DACK\u2019s activity and the public corruption scandals that have actively accompanied it in recent years have been repeatedly covered by the CPLR\u2019s experts (more information available in the weekly analyses of\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-13-20-travnya-2019-roku\/\" target=\"_blank\" rel=\"noreferrer noopener\">May 13-20<\/a>, 2019,\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-13-20-sichnya-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">January 13-20<\/a>,\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-13-20-lypnya-2020-roku\/\" target=\"_blank\" rel=\"noreferrer noopener\">July 13-20<\/a>,\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-20-27-lypnya-2020-roku\/\" target=\"_blank\" rel=\"noreferrer noopener\">July 20-27<\/a>,\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-1-7-veresnya-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">September 1-7<\/a>,\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-15-21-veresnya-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">September 15-21<\/a>,\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-20-26-zhovtnya-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">October 20-26<\/a>,\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-27-zhovtnya-2-lystopada-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">October 27 \u2013 November 2<\/a>, 2020,\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/shhotyzhnevyj-analiz-9-15-lyutogo-2021-roku\/\" target=\"_blank\" rel=\"noreferrer noopener\">February 9-15<\/a>,\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/shhotyzhnevyj-analiz-16-22-lyutogo-2021-roku\/\" target=\"_blank\" rel=\"noreferrer noopener\">February 16-22<\/a>,\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/weekly-analysis-april-6-12-2021\/\" target=\"_blank\" rel=\"noreferrer noopener\">April 6-12<\/a>, 2021).<\/p>\n\n\n\n<p>Secret investigative actions data published in 2019 and 2020 may testify to the \u00abtrading in justice\u00bb by the judges of the DACK, attempts by the head of this court to seize power in the Higher Qualifications Commission of Judges (HQCJ) and the High Council of Justice (HCJ), and interference in the activities of other authorities (Constitutional Court, Supreme Court and other courts, the National Agency on Corruption Prevention). The DACK\u2019s influence was primarily caused by its \u201cexclusive\u201d jurisdiction \u2013 this court considered disputes against regulations of the Government, ministries, other central executive bodies, and the National Bank, the NA\u0421P, and other authorities whose jurisdiction extends to the entire territory of Ukraine.<\/p>\n\n\n\n<p>Back in July 2020, experts of the CPLR\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-13-20-lypnya-2020-roku\/\" target=\"_blank\" rel=\"noreferrer noopener\">called<\/a>\u00a0the reorganization of the DACK a matter of national security of Ukraine, and Ukraine recognized the seriousness of the issue even at the international level. Thus,\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-8-15-chervnya-2020-roku\/\" target=\"_blank\" rel=\"noreferrer noopener\">memorandum<\/a>\u00a0with the International Monetary Fund discussed in 2020 the need to transfer the jurisdiction over administrative cases of national importance to the Supreme Court.<\/p>\n\n\n\n<p>2. Adopted laws only liquidated the DACK and specified that a new court is to be created in its place. Former judges of the DACK will not lose their status as judges and will continue to receive a remuneration as judges without administering justice. Their professional fate will depend on the HQCJ (currently not functioning) and the HCJ (currently not competent). In particular, it is the HQCJ that will determine whether: 1) a competition will be announced for the newly created court (instead of the DACK), or 2) it will be formed by transferring judges (in particular or primarily from the DACK). Should the second option be chosen, the goals of the new law will not be achieved. In the event that a competition is conducted, the DACK judges would be able to apply for it or resign voluntarily. They may also be transferred to another court, and in the absence of consent, they would face removal. The final decision on the issue of removal and transfer of judges is within the HCJ\u2019s purview.<\/p>\n\n\n\n<p>3. The adopted laws do not address the main reason that made the DACK a highly influential court \u2013 its \u00abexclusive\u00bb jurisdiction. Draft law\u00a0<a href=\"https:\/\/w1.c1.rada.gov.ua\/pls\/zweb2\/webproc4_1?pf3511=71088\" target=\"_blank\" rel=\"noreferrer noopener\">\u21165067<\/a>, which was introduced back in February 2021 was supposed to partially address this issue (transfer of cases involving disputes against regulations of central authorities to the Supreme Court), still remains in Parliament without movement after being adopted as a framework in November 2021.<\/p>\n\n\n\n<p>According to the CPLR\u2019s experts, the only way to comprehensively address the so-called \u00abissue of the DACK\u00bb and prevent the emergence of an extremely influential court of first instance in the judicial system is by establishing the High Administrative Court (modeled after the High Anti-Corruption Court, i.e., within the court of first and appellate instance) for hearing administrative cases of national importance.
