Horokh, S. Melenko, M Khavronyuk and D.&nbsp; Lukyanov.<\/p>\n\n\n\n<p>On the same and the following day (July 1), eight more candidates for the HCJ were\u00a0<a href=\"https:\/\/ec.court.gov.ua\/ec\/pres-centr\/news\/1289318\/\" target=\"_blank\" rel=\"noreferrer noopener\">interviewed<\/a>\u00a0by the Ethics Council under the quota of the Congress of Judges.<\/p>\n\n\n\n<p>Also on June 30, the Council of Prosecutors\u00a0<a href=\"https:\/\/court.gov.ua\/press\/news\/1291022\" target=\"_blank\" rel=\"noreferrer noopener\">informed<\/a>\u00a0the Office of the Verkhovna Rada of the date of the extraordinary all-Ukrainian conference of prosecutors, which is scheduled for August 26 of this year, and the fact that its agenda includes the election of two HCJ members. The acceptance of documents from candidates started on July 4.<\/p>\n\n\n\n<p><strong>CPLR\u2019s assessment<\/strong><\/p>\n\n\n\n<p>1. In total, the Congress of Scholars elects two members for the HCJ. Currently, one position is vacant. Another position is held by V. Hryshchuk, who in May 2022 was\u00a0<a href=\"https:\/\/ec.court.gov.ua\/userfiles\/media\/new_folder_for_uploads\/ec\/rishennj_6_07_05_2022.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">found<\/a>\u00a0by the Ethics Council as not meeting the criteria of integrity and professional ethics. According to the law, the Congress of Scholars must consider the issue of his dismissal within three months.<\/p>\n\n\n\n<p>Initially, the Congress of Scholars that was supposed to fill the vacant HCJ position was scheduled for December 2021, but due to the fact that the Ethics Council did not provide a list of candidates recommended for election, the work of the Congress was\u00a0<a href=\"https:\/\/yur-gazeta.com\/golovna\/zyizd-naukovciv-zrobiv-perervu-u-roboti-cherez-nenadannya-etichnoyu-radoyu-spisku-kandidativ-dlya-ob.html\" target=\"_blank\" rel=\"noreferrer noopener\">suspended<\/a>\u00a0for an indefinite period. Thus, in the near future, the Congress of Scholars can resume its activity, fill the vacant HCJ positions, and consider the issue of V. Hryschuk\u2019s dismissal.<\/p>\n\n\n\n<p>According to DEJURE Foundation, the Anti-Corruption Action Center, and Automaidan, there are circumstances that could indicate the failure to meet the integrity criteria by two of the candidates (<a href=\"https:\/\/www.pravda.com.ua\/cdn\/graphics\/2022\/negidni_staty_chlenamy_vyshhoi_rady_pravosuddja\/#rec404838435\" target=\"_blank\" rel=\"noreferrer noopener\">R. Melenko<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.pravda.com.ua\/cdn\/graphics\/2022\/negidni_staty_chlenamy_vyshhoi_rady_pravosuddja\/\" target=\"_blank\" rel=\"noreferrer noopener\">D. Lukyanov<\/a>) recommended by the Ethics Council. However, due to the fact that the Ethics Council did not broadcast the interviews, it is impossible to assess whether those candidates managed to refute such circumstances.<\/p>\n\n\n\n<p>2. As previously\u00a0<a href=\"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-17-23-may-2022\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>\u00a0by the CPLR\u2019s experts, the Congress of Judges where eight members of the HCJ were supposed to be elected was scheduled for July 11-13. However, on July 4, the Council of Judges\u00a0<a href=\"http:\/\/rsu.gov.ua\/ua\/news\/rada-suddiv-ukraini-vidklala-provedenna-zizdu-suddiv-ukraini\" target=\"_blank\" rel=\"noreferrer noopener\">postponed<\/a>\u00a0the Congress, as the Ethics Council did not have time to interview all the candidates for the HCJ.<\/p>\n\n\n\n<p>3. In recent months, the procedure for constituting the HCJ\u2019s composition has intensified.
