The need for rapid adoption of amendments to the Laws of Ukraine \u00abOn High Council of Justice\u00bb and \u00abOn the Judiciary and the Status of Judges\u00bb (i.e., laws\u00a0<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/1635-20#n33\" target=\"_blank\" rel=\"noreferrer noopener\">\u21161635-\u0406\u0425<\/a>\u00a0on the reform of the High Council of Justice (HCJ) and\u00a0<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/1629-20#Text\" target=\"_blank\" rel=\"noreferrer noopener\">\u21161629-\u0406\u0425<\/a>\u00a0on restart of the competition to the High Qualifications Commission of Judges) was noted separately.<\/p>\n\n\n\n<p><strong>The CPLR\u2019s assessment<\/strong><\/p>\n\n\n\n<p>The joint statement emphasized at least twice the importance of comprehensive judicial reform. This is not the first time in the issue of judicial reform in Ukraine has been discussed at the international level in the last few years. In particular, it was included in memoranda with the\u00a0<a href=\"https:\/\/pravo.org.ua\/en\/analytical-materials\/politychnyj-analiz-podij-8-15-chervnya-2020-roku-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">International Monetary Fund<\/a>\u00a0(June 2020) and the\u00a0<a href=\"https:\/\/pravo.org.ua\/en\/analytical-materials\/politychnyj-analiz-podij-20-27-lypnya-2020-roku-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">European Union<\/a>\u00a0(July 2020). Moreover, the Ukrainian reforms, including judicial, were\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/shhotyzhnevyj-analiz-9-15-lyutogo-2021-roku\/\" target=\"_blank\" rel=\"noreferrer noopener\">assessed<\/a>\u00a0by the European Parliament in February 2021.<\/p>\n\n\n\n<p>At the same time, despite repeated\u00a0<a href=\"https:\/\/twitter.com\/G7AmbReformUA\/status\/1441034815948607494?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1441034815948607494%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fukrainian.voanews.com%2Fa%2Fsudova-reforma-g7%2F6242929.html\" target=\"_blank\" rel=\"noreferrer noopener\">urges<\/a>\u00a0of the international partners and even President Volodymyr Zelensky\u2019s public\u00a0<a href=\"https:\/\/www.president.gov.ua\/en\/news\/prezident-ne-dopustit-blokuvannya-sudovoyi-reformi-70661\" target=\"_blank\" rel=\"noreferrer noopener\">statements<\/a>, judicial reform remains in its initial stage. Thus, there is a\u00a0<a href=\"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-28-september-4-october-2021\/\" target=\"_blank\" rel=\"noreferrer noopener\">delay<\/a>\u00a0in the establishment of the Ethics Council, which should play a key role in the HCJ reform; the\u00a0<a href=\"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-13-20-july-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">issue<\/a>\u00a0of the District Administrative Court of Kyiv is not addressed; and, according to the\u00a0<a href=\"https:\/\/uareforms.org\/monitoring\/sudova-reforma\" target=\"_blank\" rel=\"noreferrer noopener\">monitoring<\/a>\u00a0results conducted in June 2021, none of 17 civil society recommendations on judicial reform have been implemented by the authorities in full, while 13 recommendations have been partially implemented. Currently, the implementation of judicial reform depends on the Council of Judges of Ukraine, which\u00a0<a href=\"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-28-september-4-october-2021\/\" target=\"_blank\" rel=\"noreferrer noopener\">delays<\/a>\u00a0the delegation of their representatives to the Ethics Council, as well as on the Constitutional Court, to which the Supreme Court submitted a\u00a0<a href=\"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-5-11-october-2021\/\" target=\"_blank\" rel=\"noreferrer noopener\">petition<\/a>\u00a0placing in doubt the constitutionality of powers and functioning of the Ethics Council.<\/p>\n\n\n\n<p>It should be recalled that last week, the CPLR jointly with other civic organizations\u00a0<a href=\"https:\/\/pravo.org.ua\/en\/no-stepping-back-in-the-judicial-reform\/\" target=\"_blank\" rel=\"noreferrer noopener\">called on<\/a>\u00a0the President and the Parliament to remove the Council of Judges of Ukraine from the procedure of the Ethics Council formation trough legislative amendments and to introduce a genuine competitive selection of judges of the Constitutional Court.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Judicial reform is vital to strengthening Ukraine&#8217;s resilience and future success: Ukraine-EU Joint Statement.
