{"id":4852,"date":"2021-10-12T06:24:25","date_gmt":"2021-10-12T03:24:25","guid":{"rendered":"https:\/\/pravo.org.ua\/analytical-materials\/weekly-analytics-for-5-11-october-2021\/"},"modified":"2025-11-26T12:38:21","modified_gmt":"2025-11-26T10:38:21","slug":"weekly-analytics-for-5-11-october-2021","status":"publish","type":"analytical-materials","link":"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-5-11-october-2021\/","title":{"rendered":"Weekly analytics for 5 \u2013 11 October 2021"},"content":{"rendered":"<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_69_1 counter-flat ez-toc-counter ez-toc-transparent ez-toc-container-direction\">\n<div class=\"ez-toc-title-container\">\n<p class=\"ez-toc-title\" style=\"cursor:inherit\">Sections<\/p>\n<span class=\"ez-toc-title-toggle\"><\/span><\/div>\n<nav><ul class='ez-toc-list ez-toc-list-level-1 ' ><li class='ez-toc-page-1'><a class=\"ez-toc-link ez-toc-heading-1\" href=\"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-5-11-october-2021\/#The_Supreme_Court_puts_the_cleansing_of_the_HCJ_in_jeopardy\" title=\"The Supreme Court puts the cleansing of the HCJ in jeopardy\">The Supreme Court puts the cleansing of the HCJ in jeopardy<\/a><\/li><\/ul><\/nav><\/div>\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Supreme_Court_puts_the_cleansing_of_the_HCJ_in_jeopardy\"><\/span>The Supreme Court puts the cleansing of the HCJ in jeopardy<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p><strong>Event<\/strong><\/p>\n\n\n\n<p>On October 8, the Plenum of the Supreme Court\u00a0<a href=\"https:\/\/supreme.court.gov.ua\/supreme\/pres-centr\/news\/1192170\/\" target=\"_blank\" rel=\"noreferrer noopener\">submitted<\/a>\u00a0a constitutional petition to the Constitutional Court on the constitutionality of certain provisions of Law \u2116<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/1635-IX#Text\" target=\"_blank\" rel=\"noreferrer noopener\">1635-\u0406\u0425<\/a>\u00a0(on the reform of the High Council of Justice (HCJ)).<\/p>\n\n\n\n<p>The full text of the Supreme Court\u2019s petition has not been published yet, but according to the information notice on the Court\u2019s website, the petition raises the questions regarding constitutionality of the following provisions of the Law:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>on the tie-breaking vote of international experts in the Ethics Council\u2019s composition in case of equal distribution of votes;<\/li>\n\n\n\n<li>on the Ethics Council\u2019s \u00abre-assessment\u00bb of the integrity of those current members of the HCJ who are sitting judges and have already passed the qualification assessment;<\/li>\n\n\n\n<li>on the automatic suspension of an HCJ member in respect of whom the Ethics Council has made a recommendation for dismissal;<\/li>\n\n\n\n<li>on the dismissal of an HCJ member in respect of whom the authorized entity has not made a decision on dismissal or rejection of the recommendation of the Ethics Council within the specified period.<\/li>\n<\/ul>\n\n\n\n<p><strong>The<\/strong>&nbsp;<strong>CPLR\u2019s<\/strong>&nbsp;<strong>assessment<\/strong><\/p>\n\n\n\n<p>The submitted petition raises questions about constitutionality of key provisions of the law, without which the cleansing of the HCJ is impossible. In the absence of these provisions, the members of the Ethics Council appointed under the Council of Judges quota will be able to block any decision, and the entities entitled to appoint\/ elect the members of the HCJ will be able to refuse considering the Ethics Council\u2019s recommendations on dismissal of the HCJ members without any consequences, thereby enabling the latter to remain in office. At the same time, the Venice Commission, as an expert body in the constitutional law area established by the Council of Europe, positively&nbsp;<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/shhotyzhnevyj-analiz-4-11-travnya-2021-roku\/\">assessed<\/a>&nbsp;the respective law, and its recommendations were taken into account.<\/p>\n\n\n\n<p>It should be recalled that the Constitutional Court\u00a0<a href=\"https:\/\/pravo.org.ua\/rishennya-konstytutsijnogo-sudu-pro-nekonstytutsijnist-sudovoyi-reformy-zelenskogo-yurydychnyj-analiz\/\" target=\"_blank\" rel=\"noreferrer noopener\">found<\/a>\u00a0unconstitutional a significant portion of the earlier judicial reform initiated by President Volodymyr Zelensky in 2019, similarly following the Supreme Court\u2019s petition. At that time, the decision was lacking adequate reasoning. There was also\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-13-20-lypnya-2020-roku\/\" target=\"_blank\" rel=\"noreferrer noopener\">information<\/a>\u00a0about connection between certain Constitutional Court judges and the leadership of the District Administrative Court of Kyiv, which supposedly influences decisions of the Constitutional Court. Previously, the Constitutional Court issued a number of decisions that\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-27-zhovtnya-2-lystopada-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">jeopardized<\/a>\u00a0anti-corruption measures without adequate reasoning, which were criticized by both\u00a0<a href=\"https:\/\/pravo.org.ua\/tsppr-zaklykaye-prezydenta-ta-parlament-vzhyty-negajnyh-zahodiv-dlya-ponovlennya-e-deklaruvannya\/\" target=\"_blank\" rel=\"noreferrer noopener\">society<\/a>\u00a0and Ukraine\u2019s international\u00a0<a href=\"https:\/\/www.eurointegration.com.ua\/news\/2020\/10\/29\/7115905\/\" target=\"_blank\" rel=\"noreferrer noopener\">partners<\/a>.<\/p>\n\n\n\n<p>It is possible that this time, the Supreme Court\u2019s petition could once again be used to terminate the reforms.
