{"id":4805,"date":"2020-12-07T15:34:00","date_gmt":"2020-12-07T13:34:00","guid":{"rendered":"https:\/\/pravo.org.ua\/analytical-materials\/weekly-analytics-for-1-7-december-2020\/"},"modified":"2025-05-26T12:38:07","modified_gmt":"2025-05-26T09:38:07","slug":"weekly-analytics-for-1-7-december-2020","status":"publish","type":"analytical-materials","link":"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-1-7-december-2020\/","title":{"rendered":"Weekly analytics for 1 \u2013 7 December 2020"},"content":{"rendered":"<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_69_1 counter-flat ez-toc-counter ez-toc-transparent ez-toc-container-direction\">\n<div class=\"ez-toc-title-container\">\n<p class=\"ez-toc-title\" style=\"cursor:inherit\">Sections<\/p>\n<span class=\"ez-toc-title-toggle\"><\/span><\/div>\n<nav><ul class='ez-toc-list ez-toc-list-level-1 ' ><li class='ez-toc-page-1'><a class=\"ez-toc-link ez-toc-heading-1\" href=\"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-1-7-december-2020\/#High_Council_of_Justice_continues_to_submit_applications_for_the_appointment_of_judges_who_have_not_passed_the_qualification_assessment\" title=\"High Council of Justice continues to submit applications for the appointment of judges who have not passed the qualification assessment\">High Council of Justice continues to submit applications for the appointment of judges who have not passed the qualification assessment<\/a><\/li><li class='ez-toc-page-1'><a class=\"ez-toc-link ez-toc-heading-2\" href=\"https:\/\/pravo.org.ua\/en\/analytical-materials\/weekly-analytics-for-1-7-december-2020\/#The_government_plans_to_introduce_artificial_intelligence_to_assist_in_the_administration_of_justice\" title=\"The government plans to introduce artificial intelligence to assist in the administration of justice\">The government plans to introduce artificial intelligence to assist in the administration of justice<\/a><\/li><\/ul><\/nav><\/div>\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"High_Council_of_Justice_continues_to_submit_applications_for_the_appointment_of_judges_who_have_not_passed_the_qualification_assessment\"><\/span>High Council of Justice continues to submit applications for the appointment of judges who have not passed the qualification assessment<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p><strong>Event<\/strong><\/p>\n\n\n\n<p>In a weekly\u00a0<a href=\"https:\/\/pravo.org.ua\/analytical-materials\/politychnyj-analiz-podij-24-30-lystopada-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">analysis<\/a>\u00a0for November 24-30, 2020, the CPLR experts reported that on November 27, the High Council of Justice (HCJ), in violation of the statutory procedure, ignoring the findings of the Public Council of Integrity (PCI), submitted to the President a motion to appoint eight judges whose five-year term of office has expired.<\/p>\n\n\n\n<p>On December 1, with a similar violation, the HCJ\u00a0<a href=\"https:\/\/hcj.gov.ua\/news\/vrp-vyrishyla-vnesty-prezydentu-ukrayiny-podannya-pro-pryznachennya-devyaty-kandydativ-na\" target=\"_blank\" rel=\"noreferrer noopener\">submitted<\/a>\u00a0a motion to appoint nine more judges for an indefinite term.<\/p>\n\n\n\n<p>On December 2, the PCI and more than a dozen NGOs\u00a0<a href=\"https:\/\/grd.gov.ua\/news\/hromads-kist-vymahaie-prypynyty-zlochynne-pryznachennia-nedobrochesnykh-suddiv\/\" target=\"_blank\" rel=\"noreferrer noopener\">called on<\/a>\u00a0the HCJ to cease its gross violation of the Constitution in the appointment of judges and to abolish illegal decisions; the President \u2013 to leave without consideration the submitted proposals; the President and the Parliament \u2013 to introduce and adopt draft laws that will ensure the renewal of the HCJ and the launch of the new High Qualification Commission of Judges (hereinafter \u2013 HQCJ).<\/p>\n\n\n\n<p>On the same day, the HCJ press service published a\u00a0<a href=\"https:\/\/hcj.gov.ua\/news\/zaklyk-grd-do-prezydenta-ne-pryznachaty-suddiv-spryamovanyy-na-poglyblennya-kadrovoyi-kryzy\" target=\"_blank\" rel=\"noreferrer noopener\">response<\/a>\u00a0to the PCI\u2019s address. The HCJ justified the legitimacy of its actions by the provisions of the Law No.<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/679-20#Text\" target=\"_blank\" rel=\"noreferrer noopener\">679-\u0406\u0425<\/a>, which gives it the power to make submissions in relation to judges who have been found by the HQCJ board to qualify for the office. According to the HCJ, the fact of passing the qualification assessment is confirmed by the decision of the board of HQCJ, and not by the plenary composition of the Commission. As the powers of the HQCJ were terminated ahead of schedule in November 2019, it is currently impossible to confirm the decision of the HQCJ boards by the plenary composition of the commission.<\/p>\n\n\n\n<p>On December 3, the HCJ\u00a0<a href=\"https:\/\/hcj.gov.ua\/news\/vrp-uhvalyla-vnesty-prezydentovi-ukrayiny-podannya-pro-pryznachennya-9-suddiv\" target=\"_blank\" rel=\"noreferrer noopener\">submitted<\/a>\u00a0an application for the appointment of nine more judges for an indefinite period, one of whom (V.P. Kytsyuk) was not passing the qualification assessment at all. So far, the HCJ has managed to make submissions on the appointment of 43 judges, ignoring the PCI\u2019s findings.<\/p>\n\n\n\n<p>According to the HCJ\u2019s official website, applications on 11 more such judges are scheduled to be heard on December 10.<\/p>\n\n\n\n<p><strong>CPLR assessment<\/strong><\/p>\n\n\n\n<p>As the CPLR experts have already reported, the transitional provisions of the Constitution stipulate that a judge appointed earlier for five years must pass a qualification assessment. In the case of judges submitted on 27 November, 1 and 3 December, the qualification assessment was not completed, as the PCI\u2019s conclusions did not give effect to the decisions of the HQCJ\u2019s panels on the suitability of such judges for the positions held and this was stated in such decisions. If there is a conclusion on the PCI in relation to a judge, he\/she can successfully pass the qualification assessment only if the decision of the HQCJ\u2019s panel is made by the votes of at least 11 members of the commission (Article 88 of the Law \u201cOn the Judiciary and the Status of Judges\u201d).<\/p>\n\n\n\n<p>There are no exceptions to this legal requirement. In interpreting this provision, the Grand Chamber of the Supreme Court stated:&nbsp;<em>\u201cif in the process of qualification assessment there is such a legal phenomenon or circumstance as the conclusion of the PCI, then the&nbsp;<u>law imperatively and without alternative determines when the decision of the panel of the HQCJ on the judge\u2019s ability to administer justice in the relevant judge takes final effect.\u201d&nbsp;<\/u><\/em>(decisions in cases No.&nbsp;<a href=\"https:\/\/reyestr.court.gov.ua\/Review\/90458949\">9901\/489\/19<\/a>,&nbsp;<a href=\"https:\/\/reyestr.court.gov.ua\/Review\/90458948\">9901\/381\/19<\/a>).<\/p>\n\n\n\n<p><a href=\"https:\/\/www.facebook.com\/andriyko\/posts\/10158900412758841\" target=\"_blank\" rel=\"noreferrer noopener\">According<\/a>\u00a0to A. Kozlov, a former member of the HQCJ, 10 of the 33 people currently nominated by the HCJ are delegates to the next congress of judges, which will decide on the election of four HCJ members, a judge of the Constitutional Court and members of the Council of Judges of Ukraine. Such illegal actions of the HCJ can be explained by the intention of its members to influence the results of the forthcoming congress of judges.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_government_plans_to_introduce_artificial_intelligence_to_assist_in_the_administration_of_justice\"><\/span>The government plans to introduce artificial intelligence to assist in the administration of justice<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p><strong>Event<\/strong><\/p>\n\n\n\n<p>On December 2, the Cabinet of Ministers\u00a0<a href=\"https:\/\/thedigital.gov.ua\/news\/mikhaylo-fedorov-rozvivayuchi-sferu-shtuchnogo-intelektu-mi-zabezpechuemo-konkurentospromozhnist-ukraini-na-mizhnarodnomu-rinku\" target=\"_blank\" rel=\"noreferrer noopener\">approved<\/a>\u00a0the Concept for the Development of Artificial Intelligence in Ukraine, developed by the Ministry of Digital Transformation. Implementation of the Concept is scheduled for 2030. One of the priority areas in which the concept will be implemented is justice.<\/p>\n\n\n\n<p>The following tasks in this area should be completed over the next ten years:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>\u00a0Further development of existing technologies in the field of justice (electronic court, Unified Judicial Information and Telecommunication System, etc.).<\/li>\n\n\n\n<li>\u00a0Implementation of advisory programs based on artificial intelligence (hereinafter \u2013 AI), which will open access to legal advice to the general public.<\/li>\n\n\n\n<li>\u00a0Prevention of socially dangerous phenomena by analyzing the available data using AI.<\/li>\n\n\n\n<li>\u00a0Determining the necessary measures for resocialization of convicts by analyzing the available data with the help of AI.<\/li>\n\n\n\n<li>\u00a0Making court decisions in cases of insignificant complexity (by mutual consent of the parties) on the basis of the results of the analysis carried out using AI, the state of compliance with legislation and case law.<\/li>\n<\/ol>\n\n\n\n<p>In addition, it is proposed to use AI to identify unfair practices in the activities of officials and civil servants by analyzing the texts of management decisions and other data generated in the registers\/systems during such activities.<\/p>\n\n\n\n<p><strong>CPLR assessment<\/strong><\/p>\n\n\n\n<p>CPLR experts support the idea of \u200b\u200bintroducing AI in the field of justice. This will free up the human resources involved in performing routine tasks that the computer can handle better.<\/p>\n\n\n\n<p>Further development of technologies in the field of justice, simplification of access to justice through the creation of advisory programs, as well as the introduction of the possibility of adopting court decisions in cases of minor complexity by AI can have a positive impact on the quality of justice.<\/p>\n\n\n\n<p>In addition, it should be noted that AI in justice can be used much more widely than suggested in the concept.
